Rapp amendment excludes 65th district from health non-compete ban

Rep. Kathy L. Rapp, Republican chair of the House Health Committee, announced that the committee has approved a bill to ban non-compete agreements in health care employment contracts. An amendment was included, which exempts employers from certain conditions in sixth-, seventh-, and eighth-class counties such as Warren, Crawford, and Forest. House Bill 1633 now moves to the full House for further consideration.

“Our rural health care providers are already facing a workforce crisis,” Rapp stated. “Non-compete clauses are one of the few tools rural health systems have to ensure the high investments they make in their staff won’t be wasted. I understand the intent behind this bill is to ensure doctors aren’t forced to uproot their families in more urban areas where there are plenty of health systems to choose from. However, in rural Pennsylvania, this is simply not the case.”

In addition to the non-compete agreement bill, the Health Committee approved two other bills and four resolutions for consideration by the full House. One bill aims to define and create a license for “virtual manufacturers” who distribute prescription drugs with their principal place of business in the Commonwealth but never physically handle controlled substances within it.

Senate Bill 668 seeks to establish a training program for nurse aides in long-term care facilities to become certified in medication administration. The committee approved resolutions to recognize "Tardive Dyskinesia Awareness Week" from May 5-11, "National Athletic Training Month" in March 2024, "Necrotizing Enterocolitis (NEC) Day" on May 17, and "Retinal Blindness Awareness Month" in April 2024.
